CAPX Real Estate Partners, also referred to as the CAPX Multifamily Fund (“we”, “our” or “us”), is committed to protecting your privacy. This Privacy Policy explains how your personal information is collected, used and disclosed by us. The group is made up of the following affiliated entities:
- CAPX RE Partners I, S.A.P.I. de C.V. — manager of the fund.
- CAPX RE Partners II, S.A.P.I. de C.V. — investment vehicle for Mexican investors.
- CAPX III, LLC — United States pass-through entity, wholly owned by CAPX RE Partners II, S.A.P.I. de C.V.
- CAPX IV, LLC — investment vehicle for United States investors and holder of the investment assets.
The entity responsible for your information under this Privacy Policy is CAPX RE Partners I, S.A.P.I. de C.V., with address at Av. Ricardo Margáin 440, Int. M-01, Col. Valle del Campestre, San Pedro Garza García, Nuevo León, Mexico 66265. Our country of establishment is Mexico. Processing is carried out in accordance with the Mexican Federal Law on the Protection of Personal Data Held by Private Parties and other applicable regulations.
This Privacy Policy applies to capx.fund and its associated subdomains, together our “Service”. By accessing or using the Service you signify that you have read, understood and agree to the collection, storage, use and disclosure of your personal information as described here.
2. Definitions and key terms
Wherever the following terms appear in this Privacy Policy, they carry these meanings:
- Affiliate: any person or entity that directly or indirectly controls, is controlled by, or is under common control with CAPX, whether by ownership or otherwise, including the four entities named above.

4. Purposes of processing
Primary purposes, necessary to address your request: replying to your message, following up on your enquiry, keeping a record of the communications received, and maintaining the security and operation of the Service.
Secondary purposes: sending institutional communications about CAPX. If you do not wish your data to be processed for these purposes, you may say so at any time by writing to info@capx.fund.
6. Third-party services and links
We may display, include or make available third-party content, or provide links to third-party websites or services. CAPX is not responsible for any third-party service, including its accuracy, completeness, timeliness, validity, copyright compliance, legality, decency or quality, and assumes no liability for it. You access and use third-party services entirely at your own risk and subject to those third parties' own terms.
When you follow a link away from the Service, this Privacy Policy no longer applies. Your browsing and interaction on any other website is subject to that website's own rules and policies, and such third parties may use their own cookies or other methods to collect information about you.
We use the Google Maps API to show the location of our office. It may collect information from you and from your device for security purposes, and holds it in accordance with its own privacy policy.
We may use remarketing services, which serve advertisements across the internet to people who have already visited our Website.
7. Transfers and disclosure
CAPX does not sell the personal information of its users, and does not transfer your personal data to third parties without your consent, except in the cases provided for by law.
We may share it with suppliers that provide services to us, for example website hosting, email and the Investor Portal, who are required to process it solely in accordance with our instructions and to keep it confidential.
We may disclose information about you to our Affiliates, who will treat it in accordance with the terms of this Privacy Policy.
We reserve the right to transfer information to a third party in the event of a sale, merger or other transfer of all or substantially all of the assets of CAPX or any of its Affiliates, or in the event that we discontinue our business or become subject to bankruptcy, reorganization or similar proceedings, provided that the third party agrees to adhere to the terms of this Privacy Policy.
8. ARCO rights
You have the right to access your personal data, rectify it if it is inaccurate, cancel it when you consider that it is not required for the stated purposes, or object to its processing. You may also withdraw the consent you have given, or request that we limit the use or disclosure of your data.
To exercise these rights, send a request to info@capx.fund including your name, a means of replying to you, a copy of official identification and a clear description of the right you wish to exercise. We will respond within a maximum of 20 business days.
Such updates, corrections, changes and deletions have no effect on other information that we maintain, or on information already provided to third parties in accordance with this Privacy Policy.
9. California residents
The California Consumer Privacy Act and the California Online Privacy Protection Act require us to disclose the categories of personal information we collect and how we use it, the categories of sources from which we collect it, and the third parties with whom we share it, all of which are explained above. California residents may exercise the following rights:

This Privacy Policy is governed by the laws of Mexico, without regard to its conflict of laws provisions. You consent to the exclusive jurisdiction of the competent courts of Monterrey, Mexico in connection with any action or dispute arising under or in connection with it.
